On Tuesday, May 7, 1991, at approximately 2:30 p.m., SAS J. C. WHIDBY talked by telephone to LON TAYLOR, owner of TAYLOR'S Body SHop and Wrecker Service, Eatonton, Georgia. This conservation was regarding TAYLOR'S Wrecker Service towing a vehicle belonging to WALLACE FUGATE.
MR. TAYLOR advised on Saturday, May 4, 1991, at approximately 10:00 a.m., he received a call from WALLACE FUGATE requesting a wrecker on Hwy 212 just inside Baldwin County to tow his vehicle which had broken down on him.
MR. TAYLOR dispatched a wrecker to this location and upon arrival at the location the vehicle was found to be where FUGATE had stated it would be. However, WALLACE FUGATE was not present at the vehicle and there were no keys in the vehicle.
According to MR. TAYLOR, the wrecker hooked to MR. FUGATE'S 1957 Ford vehicle and towed it back to TAYLOR'S Body Shop, Eatonton, Georgia.
